'위빙'은 창작자가 창의성을 펼치고 공유하는 공간으로서, 파인딩벤자민(이하 '회사')은 유저의 아이디어와 표현의 자유를 보호하기 위해 최선을 다하고 있습니다.

위빙은 모든 유저가 안전하고 즐겁게 이용할 수 있는 플랫폼 운영을 위해 다음과 같은 콘텐츠 가이드라인을 운영합니다. 이는 위빙의 모든 콘텐츠와 영역에 적용되며, 명시되지 않은 사항은 ▲정보통신망법 ▲청소년보호법 ▲저작권법 등 관계 법령이나 정부 기관의 명령을 따릅니다. 콘텐츠 가이드라인은 당사 정책의 변경, 관계 법령이나 정부 기관의 명령 등에 따라 내용이 변경될 수 있습니다.

가이드라인 준수 의무와 위반 시 조치

위빙에 업로드하는 콘텐츠에 대한 권리와 책임은 유저에게 있으며, 회사는 창작자가 작성한 콘텐츠의 적법성·안전성·완전성·품질 등에 대해 보증하지 않습니다. 유저가 콘텐츠 가이드라인을 위반함으로써 발생하는 결과에 대한 책임도 해당 이용자에게 있음을 알려드립니다.

회사는 콘텐츠 가이드라인을 위반한 사례에 대해 다음과 같은 조치를 취할 수 있으며, 사례가 반복될수록 상위 단계의 조치를 적용합니다. 단, 정책 악용이나 서비스 부정 이용, 심각한 가이드라인 위반 사례가 나타난 경우에는 누적 없이 상위 단계의 조치가 적용될 수 있습니다.

1단계: 정책 안내 및 게시글 제한 콘텐츠 정책 위반 소지가 있거나 이와 관련한 유효 신고가 접수되면, 관리자 알림 및 이메일을 통해 안내하고 게시글의 외부 노출을 제한합니다. 유저는 위반 내용을 정정해 콘텐츠를 재공유할 수 있습니다.
2단계: 게시글 삭제 1단계 조치 후에도 수정 없이 콘텐츠를 유지 또는 재발행하거나, 콘텐츠 정책을 치명적으로 위반하는 게시글을 삭제합니다. 이용자는 게시글 본문을 열람하거나 재발행할 수 없습니다.
3단계: 서비스 제한 1~2단계 이후에도 콘텐츠 가이드라인을 지속 위반하면, 유저의 위빙 서비스의 이용을 한시적으로 제한합니다.
4단계: 계정 제한 콘텐츠 가이드라인을 상습적으로 위반하거나 서비스 제공에 부정적 영향을 줄 수 있는 행동이 이어지면, 해당 유저를 악성 이용자로 판단하고 계정을 영구 차단합니다. 차단된 계정으로는 로그인 할 수 없습니다.

조치에 대한 별도의 확인이나 소명이 필요하다면, **[도움 센터]**를 통해 문의할 수 있습니다. 단 정책 위반이 확인되어 삭제된 게시글과 차단된 계정은 어떠한 이유로도 복구할 수 없습니다.

금지 콘텐츠

음란물

위빙 서비스 내에서는 음란물에 해당하는 콘텐츠의 게시가 엄격히 금지됩니다.

묘사가 노골적인 성적 텍스트나 이미지를 포함하는 경우
실제 또는 모의 상황에서의 강제적 성행위를 포함하는 콘텐츠
선정적이거나 과도한 노출을 포함하도록 변경되거나 생성된 콘텐츠를 제작 또는 배포하는 것을 홍보하는 경우
대가를 주고받음으로써 이뤄지는 성행위를 홍보한다고 해석할 수 있는 콘텐츠
음란성 콘텐츠나 그 링크
성인용품, 음란 사이트, 불법 정보의 홍보 및 광고를 목적으로 하는 콘텐츠

정보통신에 관한 심의규정 제8조 1항에서 정의한 유통 불가 묘사를 포함, ▲단순 저속하다거나 문란한 느낌을 넘어서서 존중·보호되어야 할 인격을 갖춘 존재인 사람의 존엄성과 가치를 심각하게 훼손·왜곡하였다고 평가할 수 있을 정도로 노골적인 표현 및 묘사가 이뤄진 경우 ▲사회통념에 비추어 전적으로 또는 지배적으로 성적 흥미에만 호소하고 하등의 문학적·예술적·사상적·과학적·의학적·교육적 가치를 지니지 아니하는 경우 ▲기타 관계 법령 및 유관기관의 기준을 위반할 소지가 있는 경우 가이드라인 위반으로 판단하여 조치가 이뤄질 수 있습니다.

위빙은 아동의 안전을 위협하는 모든 콘텐츠에 대한 게시를 엄격히 금지합니다.

아동을 성적으로 착취 또는 학대하거나 이를 조장하는 콘텐츠
미성년자의 성적 대상화
아동 성매매

아동·청소년의 성보호에 관한 법률에서는 '아동·청소년 또는 아동·청소년으로 명백하게 인식될 수 있는 사람이나 표현물이 등장하여 성적 행위를 하는 내용을 표현한 것'을 '아동·청소년성착취물'로 정의하고 있습니다. 회사는 '아동·청소년성착취물'로 판별될 소지가 있는 경우, 혹은 콘텐츠에 이에 해당할 수 있는 묘사가 포함된 경우 가이드라인 위반으로 판단하여 조치할 수 있습니다.

위험하거나 폭력적인 콘텐츠

아래의 경우, 가이드라인 위반으로 판단하여 그 정도에 따라 조치될 수 있습니다.

특정 개인이나 집단을 위협하거나, 괴롭히거나, 희롱하는 경우
자신이나 타인에게 정신적 또는 신체적 위해를 가한다고 협박하거나 이러한 행위를 옹호하는 경우
인종, 민족, 종교, 장애, 연령, 국적, 병역, 성적 지향, 성별, 성 정체성, 또는 구조적 차별이나 소외의 대상이 될 수 있는 기타 특징을 근거로 특정 개인 또는 집단에 대한 증오, 차별, 비하를 조장하는 경우
갈취를 통해 다른 사람을 착취하는 경우
동물을 학대하거나 폭력을 행사하는 내용을 홍보하는 경우
실제 범죄나 사건에 대한 피해자 모욕 및 혐오를 조장하는 경우
오물, 신체분비물 등을 구체적·사실적으로 묘사하여 혐오감을 불러일으키는 경우
절개, 수술장면 등 의료행위를 지나치게 상세히 표현하여 혐오감을 불러일으키는 경우

불법, 범죄, 사회통합 및 사회 통합을 저해하는 콘텐츠

불법적인 내용을 담고 있거나 불법 행위를 조장하는 콘텐츠, 다른 사람의 법적 권리를 침해하는 콘텐츠의 경우 가이드라인 위반으로 판단되어 조치될 수 있습니다.

범죄를 교사·방조하거나 선동할 우려가 현저한 내용
사실이 아니거나, 부정직하거나, 허위인 주장을 사용한 콘텐츠 또는 제품, 서비스를 홍보하는 행위
마약, 폭발물, 불법 금융 등 법령 위반 관련 정보
해킹 소프트웨어 또는 소스코드
개인정보 유포 등 사생활의 비밀과 자유를 침해할 우려가 현저한 내용
정당한 권한 없이 타인의 상표 또는 저작물 등 지적재산권을 침해하는 내용
명백히 거짓이며 선거 또는 민주적 절차에 대한 참여 또는 신뢰를 크게 떨어뜨릴 수 있는 주장
건강상 해를 끼치는 주장을 하거나 현재 진행 중인 주요 보건 위기 상황과 관련하여 공신력 있는 과학적 합의를 부정하는 콘텐츠
서비스 명칭이나 운영진, 회사 임직원을 사칭하여 다른 유저를 속이거나 이득을 취하는 경우

홍보 및 도배

서비스 이용 환경을 저해할 수 있는 수준의 홍보 및 도배성 글의 게시·공유 시, 가이드라인 위반으로 판단되어 조치될 수 있습니다.

저작권

저작권 및 권리 침해 게시글을 발견한 경우, [신고] 기능을 통해 조치를 요청할 수 있습니다. 저작권 침해 신고는 접수 순서대로 처리됩니다.

저작권 위반의 판단

회사는 플랫폼으로서 저작권 및 권리 침해 게시물에 대한 위법성 및 그 조각 여부 등을 법률적으로 판단할 수 없습니다. 특히 위빙에서 중점적으로 다루고 있는 '캐릭터'의 경우, 독자적 저장물성 여부에 대해 판단하는 데에 여러 법적 논쟁이 존재합니다. 저작권에 대한 정확한 판단을 위해서는 변호사 또는 전문가의 자문을 구하시는 것을 권해드립니다.

아래의 경우에 대해 적법한 절차를 거친 신고가 접수될 경우, 저작권법 제103조에 따라 임시조치가 진행됩니다.

불법 복제·프로그램 설치 권유 및 판매에 대한 내용이 포함된 경우
소설, 만화, 영화, 방송, 음원 등의 파일을 불법 공유하거나 획득 방법을 공유한 경우
저작권, 상표권, 의장권 등 타인의 권리를 무단으로 침해한 경우
원작과 원작자가 명백한 저작물의 일부 또는 전체를 무단으로 전재, 배포한 경우
저작물을 원저작자의 허락을 받지 않고 그대로 가져온 경우
기타 관계 법령을 위반할 소지가 있는 경우

저작권 침해 게시물 조치

권리를 침해당한 이용자가 적법한 절차를 거쳐 시고를 진행한 경우, 회사는 해당 게시물에 대해 30일 간 외부 게시를 제한할 수 있습니다. 임시 조치 기간이 끝난 후의 모든 절차는 당사자 합의 또는 관련 수사·중재·사법 기관의 적법한 협조 요구 및 권고·판결에 따릅니다. 만약 정당한 권리 없이 신고를 진행했다면, 저작권법 제 103조 6항에 따라 그로 인하여 발생하는 손해를 배상할 수 있으니 주의해주시기 바랍니다.

저작권법 제 103조 및 저작권법 시행령 제 42조에 따라 정당한 권리를 가진 게시자는 30일 내에 적절한 소명자료를 첨부하여 복원 신청을 할 수 있습니다. 단, 30일이 경과된 게시물은 삭제되어 복원이 불가합니다. 정당한 권리 없이 복원 신청을 접수할 경우 처리되지 않습니다.

저작권침해 신고된 게시물의 처리시에는 저작권법 시행령 제41조에 따라 신고자의 정보가 게시자에게 메일로써 안내됩니다.

위빙 내 콘텐츠의 보호

위빙 내 유저가 업로드한 모든 콘텐츠는 저작권법 및 개인정보 보호법에 따라 보호됩니다. 이를 무단으로 수집하거나 이용하는 행위는 법적 처벌을 받을 수 있습니다. 특히, 본 서비스 내에서 유저가 원하지 않는 인공지능(AI) 학습 목적의 데이터 수집을 엄격히 금지합니다.

Weaving Content Guidelines

Weaving is a space for creators to express and share their creativity, and Finding Benjamin (the "Company") is committed to protecting users' ideas and freedom of expression.

Weaving operates the following content guidelines to ensure that the platform is safe and enjoyable for all users. This applies to all content and areas of Weaving, and any unspecified matters are subject to relevant laws or orders from government agencies, such as the Information and Communication Network Act, the Youth Protection Act, and the Copyright Act. The Content Guidelines are subject to change in response to changes in our policies or orders from relevant laws or government agencies.

Your obligation to follow the guidelines and what happens if you violate them

Users are responsible for the rights and responsibilities of the content they upload to Weaving, and the Company does not guarantee the legality, safety, completeness, quality, etc. of the content created by creators. Users are also responsible for the consequences of violating the Content Guidelines.

The Company may take the following actions for violations of the Content Guidelines, with escalating levels of action applied for repeated instances. However, in cases of policy abuse, fraudulent use of the service, or serious violations of the guidelines, the higher level of action may be applied without cumulation.

Step 1: Policy guidance and post restrictionsWhen we receive a valid report of a potential content policy violation, we will provide guidance via admin notifications and email, and restrict the post's external visibility. Users can reshare the content by correcting the violation.
Step 2: Remove postsWe remove posts that remain or republish content without modification after the actions in Step 1, or that materially violate our content policy. Users will not be able to view or republish the body of the post.
Step 3: Service RestrictionIf the user continues to violate the content guidelines after steps 1 and 2, we will temporarily restrict the user's access to the Weaving service.
Step 4: Account RestrictionIf a user repeatedly violates our content guidelines or engages in behavior that may negatively impact our service, we will consider the user to be abusive and permanently block their account. You will not be able to log in with a blocked account.

Prohibited content

Pornography

The posting of content that constitutes pornography is strictly prohibited within the Weaving Service.

Contains explicitly sexual text or images in its description
Contains forced sexual activity in real or simulated situations
Promotes the creation or distribution of content that has been altered or created to include sexually explicit or nudity
Content that could be interpreted as promoting sexual activity that occurs in exchange for payment
Obscene content or links to it
Content aimed at promoting and advertising adult products, pornographic sites, or illegal information

Contains depictions that cannot be distributed as definedin Article 8, Paragraph 1 of the Deliberation Regulations on Information and Communication, If the expression or depiction is so explicit that it can be evaluated as seriously undermining or distorting the dignity and value of a person as a being with a personality that should be respected and protected beyond mere vulgarity or obscenity; if it appeals solely or predominantly to sexual interest and does not have inferior literary, artistic, ideological, scientific, medical, or educational value in light of social conventions; or if it may violate other relevant laws and standards of related organizations, it may be judged as a violation of the guidelines and measures may be taken.

Child Abuse and Exploitation

Weaving strictly prohibits the posting of any content that jeopardizes the safety of children.

Content that sexually exploits, abuses, or promotes the sexual exploitation or abuse of children
Sexual objectification of minors
Child sex trafficking

The Act on the Sexual Protection of Children and Adolescentsdefines "child and adolescent sexual exploitation" as "content that depicts a child or adolescent, or a person or expression that can be clearly recognized as a child or adolescent, engaging in sexual acts. We may take action against content that we believe violates the Guidelines if it is likely to be identified as child or youth sexual exploitation, or if it contains depictions that could be identified as such.

Dangerous or violent content

The following may be considered a violation of the Guidelines and may be subject to action, depending on the severity of the violation

Threatens, bullies, or harasses a specific person or group of people
Threatens to inflict mental or physical harm on yourself or others, or advocates such conduct
Promote hatred, discrimination, or denigration of a particular individual or group based on race, ethnicity, religion, disability, age, national origin, veteran status, sexual orientation, gender, gender identity, or any other characteristic that may subject them to structural discrimination or marginalization
Exploit others through extortion
Promotes cruelty to animals or violence against them
Promotes victim-blaming and victimization of real-life crimes or events
Arouses feelings of disgust through specific and realistic depictions of filth, bodily secretions, etc.
Excessively detailed depictions of medical procedures, such as incisions and surgeries, that arouse disgust.
Gory content that disregards life, such as excessive use of weapons and other dangerous objects to damage bodies or corpses.
Content that uses vulgar language, such as excessive profanity, to cause disgust or offense
Content that causes cruelty or disgust by realistically and specifically expressing physical or mental suffering to people or animals, etc.

Content that is illegal, criminal, or undermines social integration and social cohesion

Content that is illegal, encourages illegal behavior, or violates the legal rights of others may be determined to be in violation of the Guidelines and may be subject to action.

Content that is likely to aid, abet, or incite a crime
Promotes content or products or services using claims that are untrue, dishonest, or fraudulent.
Information about violating laws, such as drugs, explosives, or illegal finance
Hacking software or source code
Content that is likely to violate the secrecy and freedom of personal life, such as disseminating personal information
Infringes intellectual property rights, such as trademarks or copyrighted works of others without legitimate authority
Claims that are plainly false and likely to significantly undermine participation in or trust in elections or democratic processes
Content that makes claims of health harm or denies authoritative scientific consensus regarding an ongoing major health crisis
Impersonates the name of the Service, its operators, or company officials to deceive or take advantage of other users.

Promoting and defacing

If you post or share promotional or flameworthy content that may interfere with the experience of using the Service, you may be judged to be in violation of the Guidelines and may be subject to action.

Copyright

The content you post or share must be a legally created work, and you must have the necessary rights to share it. If you quote someone else's work, you may do so only after legally consulting with the copyright holder.

If you find a copyright and rights infringing post, [Report] feature to request action. Reports of copyright infringement are handled in the order they are received.

Determination of Copyright Infringement

As a platform, we cannot legally determine the legality of copyrighted and infringing posts and whether or not they are fragments. Especially in the case of "characters," which is the focus of Weaving, there are many legal debates about whether or not they are original works of authorship. We recommend that you seek the advice of a lawyer or other expert to make an accurate determination of copyright.

If a duly processed notification is received for the following cases, provisional measures will be taken in accordance with Section 103 of the Copyright Act.

Piracy - involving the solicitation and sale of program installation
Illegal sharing of files such as novels, comics, movies, broadcasts, sound recordings, etc. or sharing of methods of obtaining them
Unauthorized infringement of another's rights, such as copyright, trademark, or design rights.
Unauthorized reproduction or distribution of any part or all of the original work and the original author's obvious work.
If the work is taken as it is without the permission of the original author
Other cases that may violate relevant laws and regulations

Taking Action Against Copyright Infringing Posts

If a user whose rights have been infringed has filed a notice through due process, the Company may restrict external posting of the infringing post for 30 days. All proceedings after the end of the interim period are subject to the agreement of the parties or the lawful request for cooperation and recommendations and rulings of relevant investigative, arbitration, or judicial authorities. Please note that if you have filed a notification without legitimate rights, you may be entitled to compensation for damages arising therefrom pursuant to Article 103, Paragraph 6 of the Copyright Act.

Pursuant toArticle 103 of the Copyright Act and Article 42 of the Enforcement Decree ofthe Copyright Act, publishers with legitimate rights may apply for reinstatement within 30 days with appropriate supporting materials. However, if the 30-day period has passed, the post will be deleted and cannot be restored. Applications for restoration without legitimate rights will not be processed.

When processing a post reported for copyright infringement, the poster will be notified via email of the complainant's information in accordance with Article 41 of the Enforcement Decree of the Copyright Act.

Information required to report copyright infringement

Identification of the copyright holder (attach a power of attorney if you are represented by an agent)
The copyrighted work claimed to be infringed and documents proving that you are the copyright holder
The material or post that is allegedly infringing
Contact information of the complainant, including email address
A statement that you are the copyright owner of the material, the copyright owner's agent, or an authorized representative of the copyright owner, setting forth the basis for your claim that the material is being used in a way not authorized by law
A statement under penalty of perjury that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner.

Protecting Your Content on Weaving

All content uploaded by users within Weaving is protected by copyright and privacy laws. Any unauthorized collection or use of such content may result in legal penalties. In particular, we strictly prohibit the collection of data for the purpose of artificial intelligence (AI) training without the user's consent within the Service.

Defamation and other rights violations

The following may be considered violations of the Guidelines and may result in action.

Spreading falsehoods or rumors
Publicly slandering and defaming others
Cyber sexual assault
Cyberstalking
Leaking personal information
Other possible violations of applicable laws
